These General Conditions are for the purchase of products and services, carried out remotely via the Internet on the site www.latorroneria.it belonging to LA TORRONERIA di G.F.G. Murdolo,
The sale is governed by these General Conditions. The customer is therefore invited, before sending the order, to carefully read the general conditions of sale as identified above and the information contained therein and to print them or save them on another durable medium accessible to him.
The site was created for the sale of food products, in compliance with Italian legislation on distance contracts. Legislative Decree no. 70/2003.

The sale is governed by these General Conditions:

– The Customer can purchase the products contained in the site LATORRONERIA.IT, the publication of the same products within the site, is an invitation to the customer to make a purchase proposal. The order sent by the Customer has the value of contractual proposal and involves the complete knowledge and full acceptance of these General Conditions of Sale.
The correct receipt of the Customer’s proposal is confirmed by latorroneria.it through an automatic response sent to the email address supplied by the Customer and confirms only the correct receipt of the proposal within the information systems.

– Any order executed by the customer will be visible to the customer in his own area of purchase, the customer has the right to modify or cancel the order only if it is not sent yet, exclusively by sending a communication to the customer. Customer Service e-mail address [email protected]

Acceptance of the general conditions of sale:

-The contract stipulated between latorroneria.it and the Customer must be considered concluded with the acceptance, even if only partial, of the order by LA TORRONERIA. This acceptance is considered tacit, if not otherwise communicated with any modality to the Customer. By placing an order in the various ways provided, the Customer declares to have read all the information provided to him during the purchase procedure, and to fully accept the general conditions and payment transcribed below.

-If the Customer is a consumer (ie a physical person who purchases the goods for purposes not related to their professional activity), once the online purchase procedure is completed, will print or save an electronic copy and otherwise keep these terms and conditions of sale, in compliance with the provisions of Italian law on distance contracts.
-The Customer’s right to compensation for damages or compensation is excluded, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and / or property caused by the non-acceptance or evasion, even partial, of an order.

– The order sent by the Customer to LATORRONERIA.IT through the Internet must be completed in its entirety and must contain the elements necessary for identification of the customer and the packages ordered and indication of the place of delivery, under penalty of nullity. If there are problems with delivery due to incorrect addresses, LA TORRONERIA di G.F.G. Murdolo undertakes to return the package with costs borne by the customer.

– By sending the order, in the various ways provided by the operating instructions of the Site, the Customer declares to have read all the information provided to him during the purchase procedure, and to fully accept the Terms and Conditions of Payment described below.

-All prices of the products are clearly indicated on the Site and are inclusive of VAT. Shipping costs are shown based on the quantity purchased and the place of delivery. Minimum order 3 Kg.
-If a package is presented on the Site with the item “sold out” or otherwise without the opportunity to be placed in the cart, it is intended not available for sale through the Site.

– The prices of products, as reported on the Site, are subject to change at any time and without notice, provided that, limited to orders in course of acceptance or as accepted above by LA TORRONERIA of G.F.G. Murdolo, the sales conditions in force at the time of sending the order by the Customer will apply, except for orders that are not accepted.

-Once the order has been received, LA TORRONERIA di G.F.G Murdolo will check the availability of stocks for order fulfillment. In the event that a package is not available, the Customer Service of LA TORRONERIA of G.F.G Murdolo will send a timely notice to the customer and proceed with the cancellation of the order.

If the delivery time of the ordered product is delayed with respect to the delivery times indicated on the Site before the order LA TORRONERIA di G.F.G Murdolo undertakes to promptly notify the Customer by an e-mail to the address indicated by the Customer. Until the time of shipment by LA TORRONERIA di G.F.G. Murdolo, communicated to the Customer through an e-mail message, the Customer has the right at any time to cancel the order or modify it, exclusively by sending an e-mail to the dedicated customer care address [email protected]
the image of the packages themselves has the sole purpose of presenting them for sale and may not be fully representative of its characteristics but may differ in color, size and accessory products shown in the figure.

In the event of a difference between the image and the written product sheet, the description of the product sheet always prevails.

Terms of payment
-payments in execution of the Purchase Contracts stipulated through the Site may be made by Credit Card, Cash on Delivery and PayPal, the Customer at the time of conclusion of the Purchase Contract, after having verified the summary of the order and carried out the checks of the case, will confirm the operation. – LA TORRONERIA di G.F.G. Murdolo reserves the right to request additional information from the Customer (eg landline number) or to send copies of documents proving ownership of the Card used.
In the absence of the required documentation, LA TORRONERIA di G.F.G. Murdolo reserves the right not to accept the order.

In case of cancellation of the order, both by the Customer and in case of non-acceptance of the same by LA TORRONERIA di G.F.G. Murdolo, will be requested at the same time by LA Torroneria the cancellation of the transaction and the release of the amount involved.

The timing of release, for some types of cards, depend exclusively on the banking system and can reach their natural expiry (typically 24-25 days from the authorization date).

-A greater guarantee and security of the customer, at no time during the purchase procedure LA TORRONERIA di G.F.G. Murdolo is able to know the information relating to the buyer’s credit card, transmitted via secure connection directly to the site of the bank that manages the transaction.

In no case LA TORRONERIA di G.F.G. Murdolo can therefore be held responsible for any fraudulent and improper use of credit cards by third parties, upon payment of products purchased on latorroneria.it

Deliveries and documentation
LA TORRONERIA by G.F.G. Murdolo undertakes to deliver within 3 working days or in any case within 7 working days from the confirmation of payment, for shipments made to the islands the delivery time will be within 10 working days from the confirmation of payment.

All deliveries of products will be at risk of LA TORRONERIA di G.F.G. Murdolo.
The risk will be transferred to the Customer upon delivery of the products to the Customer by the shipper, the carrier or other agent appointed by LA TORRONERIA di G.F.G. Murdolo for delivery.
At the time of delivery of the goods by the courier, the customer is required to check that the number of packages delivered corresponds to what is indicated in the transport document, that the packaging is intact, not damaged, wet or otherwise altered, even in sealing materials (adhesive tape or plastic straps).
Any problems concerning the physical integrity, correspondence or completeness of the products received must be reported within 7 days of delivery, according to the procedures set forth in this document.
In case of failure to collect within 5 working days of the material in storage at the courier’s warehouses due to repeated inability to deliver to the address specified by the Customer when ordering, the order will be automatically canceled.

Right of withdrawal
Pursuant to Legislative Decree 06/09/05 No. 206, the consumer customer has the right to withdraw from the purchase contract for any reason, without the need to provide explanations and without any penalty, within 10 days of delivery of the products.

To exercise this right, the customer must send a written notice by registered letter with acknowledgment of receipt to LA TORRONERIA di G.F.G. Murdolo, Piazza Italia 25 – 89029 TAURIANOVA (RC) or the e-mail address [email protected] indicating the package or packages for which it intends to exercise the Right of Withdrawal, provided it is intact.

Once the aforementioned withdrawal notice has been received, the Customer Service. will promptly communicate to the customer instructions on how to return the goods.

• The right of withdrawal is however subject to the following conditions:

• the right applies to the product purchased in its entirety; it is not possible to exercise withdrawal only on part of the product purchased;

• the right of withdrawal does not apply to goods made to measure or customized.

• The purchased good must be intact.

By law, the shipping costs related to the return of the asset are charged to the customer;
The shipment, until the certificate of receipt in our warehouse, is under the complete responsibility of the customer;
In case of damage to the goods during transport, LA TORRONERIA di G.F.G. Murdolo, will inform the customer of the event, to allow him to promptly report a complaint against the courier chosen by him and obtain the reimbursement of the value of the asset (if insured); in this case, the product will be made available to the customer for his return, simultaneously canceling the request for withdrawal;

LA TORRONERIA by G.F.G. Murdolo is not responsible in any way for damage or theft / loss of goods returned by uninsured shipments;
LA TORRONERIA by G.F.G. Murdolo makes available to the customer the possibility to send the goods with insured shipping by express courier. In the event that the Customer chooses to make use of the facilitated return service, the related expenses will be deducted from the amount due to the Customer for withdrawal.
Upon arrival at the warehouse, the product will be examined to assess any damage or tampering not caused by transport. If the packaging and / or the original packaging are damaged LA TORRONERIA di G.F.G Murdolo will deduct from the refund a percentage, in any case no more than 20% of the same, as a contribution to the restoration costs.

Without prejudice to any restoration costs for damages ascertained to the original packaging, LA TORRONERIA di GFG Murdolo will refund the customer the full amount already paid, within 30 days from the return of the goods, by means of a transfer of the amount charged to the Credit or by bank transfer. In the latter case, the customer will promptly provide the bank details on which to obtain the reimbursement (ABI Code – CAB – Current Account of the invoice).

The right of withdrawal is totally lost, due to the lack of the essential condition of integrity of the goods (packaging and / or its contents), in the cases in which LA TORRONERIA ascertains:

• lack of external packaging and / or original internal packaging;

• the absence of integral elements of the product;

• damage to the product for reasons other than transport.

In case of forfeiture of the right of withdrawal, LA TORRONERIA di G.F.G Murdolo will return the purchased good to the sender, charging the shipping costs to the same.

Complaints
Any complaint must be addressed to LA TORRONERIA of G.F.G Murdolo – Piazza Italia, 25 – 89029 Taurianova (RC)

Applicable law
The contract of sale between the Customer and LA TORRONERIA of G.F.G Murdolo is concluded in Italy and governed by Italian law. For the solution of civil and criminal disputes arising from the conclusion of this contract of distance selling, if the customer is a consumer, the territorial jurisdiction is that of the reference forum of his municipality of residence; in all other cases, the territorial jurisdiction is exclusively that of the Court of Palmi.
